As expected and intended, the Board of Trustees and the Board of Directors has promptly answered the previously served Hazmana issued by the ‘Orthodox Union of Rabbis of the United States and Canada’ and served on behalf of Rabbi Mordecai Tendler. Our answer was served on both the issuing Bais Din and the Rabbi.

For informational purposes, the Hazmana provided for three usual choices, one of which was a Zablah. We have decided to choose the Zablah process, which process allows each side to pick a Borer (judge), and, thereafter the Borers Dayans to choose a third Borer. Our Answer also included the designation of our Toen (advocate) and Borer. A copy of our Answer is attached hereto.

Given our efficient response we are optimistic that the Rabbi will provide his nominations of Toen and Borer to us in writing within a similarly responsive time frame and manner. We also expect that each nominated Dayan will mutually decide on third Dayan within a short time thereafter. Aware of the many resulting issues surrounding our community, and the needed time frame for resolution, our firm expectation is to formally commence the Bais Din hearing prior to March 27th, 2006. We will keep you updated on all developments.

Lastly, we have remained consistently committed to keeping this matter private and have refrained from making any public statements. We have also committed ourselves to refrain from any additional and viable ancillary pursuits as the only issue to be decided is the Rabbi’s current and future relationship with the Kehillah. In promotion of this intended shalom, we expect all parties, and members, to honor and abide by these commitments.

As a side note, we, as always, are continuing with the necessary efforts for the management and maintenance of the Kehillah. If you have any questions in this regard, please do not hesitate to contact us.
